Policy pursuant to Article 13 of EU Regulation No. 679/2016
In accordance with Article 13 of European Regulation 679/2016, we wish to inform you of the following:
Purpose of processing:
Your personal data, freely provided and acquired by us due to the activity carried out by Chiarini Machining srl – Sole Proprietorship, will be processed lawfully and fairly for the following purposes:
administrative and accounting purposes in the management of the contractual and/or pre-contractual relationship;
Other purposes are related to promotional and informational activities.
The data processed (which may be common, identifying, sensitive, or judicial in nature) are updated, relevant, complete, and not excessive in relation to the purposes listed above for which they are collected and subsequently processed.
Processing methods:
Your data will be processed, respecting the necessary security and confidentiality, through the following methods: data collection from the data subject, collected and recorded for specific, explicit, and legitimate purposes and used in further processing operations in a manner compatible with these purposes, processing carried out with the aid of electronic and automated tools (data collection via telematic means, directly from the data subject).
Legal basis of processing:
The legal basis for processing your personal data is based on the signing of the contract, the proposal, or the offer submitted by us to you or vice versa. It is also based on your request for information or offers regarding our products or services.
Legitimate interests pursued by the Data Controller:
The legitimate interests pursued by the Data Controller in data processing require compliance with and fulfillment of contractual obligations signed between the parties or compliance with their requests. Pursuant to Article 6, the lawfulness of processing is based on the explicit consent of the data subject, documented in writing.
Mandatory or optional nature of data provision and consequences of refusal:
The provision of administrative and accounting data by you is mandatory so that the Data Controller can provide the requested services. In case of refusal, it will be impossible to proceed with the relationship, and the Data Controller will not be able to fulfill contractual obligations.
The provision of data for advertising and informational purposes, however, is not mandatory and derives from explicit consent, if given.
Data communication to third parties:
Your personal data will be processed by the Data Controller, the Data Processors appointed by them, and the authorized data processors. They may be communicated to institutional bodies upon request.
Your data may be communicated following inspections or audits (if required) to all inspection bodies responsible for verifying compliance with legal obligations.
Your data may also be communicated to companies/professional firms that provide assistance, consultancy, or collaboration to the Data Controller in accounting, administrative, tax, legal, and financial matters, to public administrations for institutional functions within the limits established by law or regulations, and to third-party service providers where communication is necessary for the fulfillment of contractual services. Your personal data will not be disclosed in any way.
Retention period:
Your personal data will be retained for 10 (ten) years from the termination of the relationship or until commercial purposes are achieved.
Existence of automated decision-making:
There is no automated decision-making process.
Intention of the Data Controller:
The Data Controller will not transfer your personal data to a third country or an international organization, except within its activities with subsidiaries.
